Terms and Conditions for the International Online Voice Competition Boris Martinovich

 

Effective Date: October 26, 2023

These Terms and Conditions ("Terms") govern your participation in the International Online Voice Competition Boris Martinovich ("Competition") and its projects hosted on www.boris-martinovich.org ("Website"). By registering for or participating in the Competition, including any associated concerts, productions, or masterclasses, you agree to be bound by these Terms. If you do not agree to these Terms, you may not participate.

1. Eligibility:

  • The Competition is open to the vocalists of all ages and nationalities

  • Participants must be at least 13 years old. There is no upper age limit

  • Participants must agree to these Terms and Conditions.

2. Registration and Submission:

  • Registration requires providing accurate information as requested on the registration form. Providing false information may lead to disqualification.

  • Participants are responsible for ensuring the quality of their audio/video submissions.

  • Submitted entries must adhere to the Competition's guidelines and rules specified on the Website [link to guidelines if applicable].

  • Participants grant the organizers a non-exclusive, royalty-free, worldwide, perpetual license to use their submitted audio/video recordings for judging purposes and potential promotional use (with proper credit unless otherwise specified).

  • Application and registration fees are non-refundable unless specifically stated otherwise.

3. Intellectual Property:

  • Participants retain ownership of their submitted work. However, by submitting an entry, participants grant the Competition organizers a non-exclusive, royalty-free, worldwide, perpetual license to use the submitted audio/video recordings for promotional and archival purposes related to the Competition. This includes, but is not limited to, use on the Website, social media, and other promotional materials. This license also extends to any recordings, images, and performances created during Competition-organized opera concerts, productions, and masterclasses, unless explicitly stated otherwise in a separate agreement.

  • Participants warrant that their submissions do not infringe on any third-party copyrights, trademarks, or other intellectual property rights.

4. Judging and Prizes:

  • The Competition's judging criteria are outlined on the Website [link to judging criteria if applicable].

  • Decisions of the judges are final and binding.

  • Prizes and awards are as described on the Website [link to prize information if applicable].

  • The organizers reserve the right to modify or cancel prizes at their discretion.

4.1 Competition-Organized Projects (Opera Concerts, Productions & Masterclasses):

  • The Competition may organize opera concerts, productions, and masterclasses as part of its activities. 

  • Details regarding participation, scheduling, roles, and responsibilities for each project will be communicated separately to selected participants

  • By participating in these projects, you grant the Competition organizers a non-exclusive, royalty-free, worldwide, perpetual license to use your image, likeness, and performance in recordings and photos for promotional purposes related to the Competition and its associated projects, unless you specifically object in writing. 

5. Liability:

  • The organizers are not liable for any technical malfunctions, delays, or errors in connection with the Competition.

  • Participants are solely responsible for any expenses incurred in preparing and submitting their entries.

  • The organizers are not liable for any loss or damage arising from participation in the Competition, except in cases of gross negligence or willful misconduct.

6. Privacy:

  • Participant information will be handled in accordance with the Competition's Privacy Policy 

7. Modification of Terms:

  • The organizers reserve the right to modify these Terms at any time. Any changes will be posted on the Website. Continued participation in the Competition and/or its projects after any changes constitutes acceptance of the revised Terms.

8. Governing Law:

  • These Terms are governed by and construed in accordance with the laws of Jurisdiction, e.g., the State of Florida, USA. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the State of Florida
